Club Memorandum Of Understanding ("MoU") in respect of the delivery of a Chance to shine ("C2S") Project in 2008.
Neither the Cricket Foundation, County Cricket Board nor the named club intends to create a legal relationship by entering into this MoU. Accordingly, neither party shall be liable to each other for any delay or default in performing any provision set out in the MoU.

PART 1 - THE PARTIES.

PART 2 - DATE.
This MoU is entered into on:

WHEREAS:
A. The CF is the Independent charity running the Chance to shine campaign,
B. The Club is a cricket club which is delivering the Chance to shine programme.
THE PARTIES THEREFORE AGREE AS FOLLOWS:
1. OBLIGATION OF THE CLUB
The Club has agreed to:
1.1 appoint a senior point of contact who will act as ‘Chance to shine’ Club Manager.
1.2 visit the Head Teachers of six identified schools with the Cricket Development Manager (“CDM”), if required, to verify teacher commitment, establish PDM involvement and confirm timetable;
1.3 In conjunction with the CDM, provide a timetable of coaching;
1.4 monitor that all sessions have been delivered;
1.5 make sure all coaches have Criminal Records Bureau (‘‘CRB’’) clearance and have attended the Working in Schools Module (WIS) coaching course, prior to the commencement of the programme;
1.6 endeavour to achieve the objectives as set out in the C2s Programme;
1.7 keep within the budgetary limits agreed in writing by the Club with the CF from time to time;
1.8 supply the CF and the CB with written confirmation if a club payroll system is to be used to pay C2s coaches;
1.9 keep an inventory of all equipment received and store safely and be responsible for losses;
1.10 ensure programmes for boys and girls from C2s schools take place at the club/school during half-term and summer holidays;
1.11 promote Chance to shine campaign within local media, by utilising press releases provided and by taking independent initiative;
1.12 promote Chance to shine Commercial Partners within the club and local community as requested;
1.13 take responsibility to ensure the overseas coaches working in C2s have
CRB clearance, have attended the WIS course, and are operating on working visa’s;
1.14 audit school facilities and complete the Play Ground Markings school site form as requested.
1.15 if selected for C2s financial review purposes, ensure all receipts for expenditure are available.
2. OBLIGATIONS OF THE CF TO PROVIDE THE C2S BENEFITS.
The CF will for the duration of the Club’s involvement in the Chance to Shine Project and subject always to a maximum of [five] years make available the C2S benefits as follows:
2.1 the opportunity to build and strengthen a quality, sustainable cricket programme within state schools;
2.2 in year one only, the CF will provide whether directly or indirectly, kit and clothing to the value of £700.00;
2.3 at the CF’s sole discretion up to:
2.3.1 £4,200.00 for coaches fees, unless agreeing with the CF and the CB to operate through a Community Coach Scheme
2.3.2 £500.00 towards competition & programme costs;
2.3.3 £400 delivery fee to the Club in April of each participating year, subject to the set timeframes being met;
2.3.4 £400 delivery fee at the completion of the programme in each participating year, subject to a successful end of programme review;
2.4 one training day for all the Club’s coaches involved in the C2S Project subject to a maximum of [four (4) ] such coaches;
2.5 tracksuits and relevant attire for coaches subject to being for a maximum of [four (4)] such coaches;
2.6 a suitable support network to facilitate the development of the ‘Chance to shine’ programme;
*The commitment for subsequent years (maximum five) is subject to the club delivering the programme to the standards required. An annual assessment of the delivery will be made at the end of programme review.
The CF’s Regional Manager will
3.1. provide appropriate support to the CDM and the Club
3.6. ensure that all information is recorded through the monitoring procedure as set out prior to the programme each year.
Subject to meeting set timeframes as set out in the ‘Next Steps’ section, your club will receive a ‘programme planning’ delivery fee of £400 in April 2008.
Also upon completion (subject to the end of programme review) of the 2008 Chance to shine programme the cricket club will receive a further award of £400 in September from the trustees of the Cricket Foundation (registered charity no. 326202). Delivery fees may only be spent by you in ways that will benefit junior boys and girls. Areas include;
Purchase and maintenance of ground equipment, eg non-turf pitches & nets
Coaching, equipment and competition for junior girls and boys
Developing Club/School links
Providing Cricket for the Disabled
Funding Training courses for coaches, groundsmen, umpires, scorers
Re-imbursement to Chance to shine Club Managers for their administration time
Pease keep accurate records of how you have spent the award. We may ask to see these records for the purposes of auditing of our charitable expenditure or in order to establish that the award has only been used for the purposes set out above.
In the event that you use our award to pay any wages you do so on the strict understanding that it shall not for any purpose whatsoever create any employment relationship with the trustees of the Cricket Foundation.

PART 4. FUNDRAISING SUPPORT.
Chance to shine clubs will be required actively to support specific fundraising initiatives of the Cricket Foundation and its trading subsidiary Cricket Foundation Enterprises Ltd. wherever practicable.
Specifically, Club Managers will be required to forward on and where possible actively promote pertinent e-mail campaigns from officially approved third party commercial partners to their club members and related networks where possible, including relevant Regional Managers on such emails to allow effective reporting and analysis.
Further promotional support may be required. However, the Chance to shine Operations Team will ensure that such support will be reasonable and realistic in terms of resources required.
PART 5. DATA PROTECTION.
USE OF PERSONAL INFORMATION.
The Cricket Foundation and its subsidiary, Cricket Foundation (Enterprises) Ltd will use your personal information in the following ways:
Your personal information will be treated as strictly confidential and will not be passed to third parties except as detailed above. Your data will not be sent to countries outside the EU.
All information kept on authorised computers will be password-protected. Personal data may be stored on 3rd party servers not owned by The Cricket Foundation or Cricket Foundation (Enterprises) Ltd should this be considered the most effective means of storage. The Cricket Foundation and Cricket Foundation (Enterprises) Ltd will ensure that the 3rd party or parties responsible for such storage will not have access to the data for any other purpose other than to fulfil their role as the nominated service provider.
